Do you think a surrogate should get to keep her child?

My opinion is emphatically "NO" to both scenarios. A surrogate should never be allowed to keep a child when she entered an agreement, whether a traditional or gestational agreement, to carry the child for another couple. A surrogacy differs greatly from an adoption situation in that a surrogate does not just "find out" she's pregnant and then is faced with having to make a heart wrenching decision of whether or not to keep the baby. A surrogate knows good and well what she's getting herself into before there is a baby. I do not think the law should differentiate between traditional and gestational because, in both cases, the surrogate plans for months prior to getting pregnant, has signed a contract, and has made promises to a couple that she will do this for them. They invest thousands of dollars to make it happen, just to have to fight for their child at the end.
